This privacy policy ("this Policy") sets out the practices of Dekal in using the information that You provide when You register with Dekal or use Dekal's Services ("Customer Information"). The terms of this Policy form a part of and are in addition to Dekal's Terms and Conditions Use, and, Disclaimers and Warning (together "Terms & Conditions"). Unless the context otherwise requires, terms and expressions defined in the Terms & Conditions have the same meanings when used in this Policy.

    Dekal will only collect and use personal data voluntarily and openly provided to this Website. Users are able to browse the Website without disclosing any personal information. A user of this Website may choose to provide Dekal with limited personal data as required in order to register for certain services. Once registered, the information will only be used for the specified purpose(s).

    From time to time, Dekal will utilize the customer contact information (ie., email address which was voluntarily and openly provided to this Website) to send the user information about improvements, new features, or important changes in Dekal's services. Users may opt-out of receiving future mailings at any time by contacting Dekal.

  2. Restrictions of Use of Customer Information

    Dekal shall not use the Customer Information or disclose the same to any party except in circumstances where the Customer Information is required:-

    2.1to provide, operate, administer and/or monitor Dekal's system and/or solution and/or Service and/or Payment Processing (as defined below) including and not limited to the verification of the accuracy of the Customer Information;

    2.2by those of Dekal's suppliers who agree to keep the Customer Information confidential, to the extent that they need such Customer Information to provide their services to Dekal and/or Dekal's customer (including You) ("Customer") so as to facilitate the provision of the Services to the Customer, including to the third party processor and/or payment account issuer and/or NCB (as defined below) during the Payment Processing;

    2.3to undertake debt tracing or to fraud prevention agencies so that the Customer Information may be made available to other organisations to help prevent fraud or to trace debtors;

    2.4to be given to any person to whom Dekal transfers its rights and/or duties under these Terms & Conditions, and to their insurers, agents, sub-contractors and suppliers (on a strictly need-to-know basis) in advance or after such transfer;

    2.5to be so disclosed at the Customer's request or where Dekal has obtained the Customer's consent;

    2.6for the purpose of seeking advice and counsel from such professional advisers as are under a duty of confidentiality with respect to the same;

    2.7to track the pattern of the Customer's activities to analyse market trends and preferences, whether for Dekal's internal use or for third parties in a manner which does not personally identify the Customer;

    2.8to send the Customer promotional or other materials which Dekal believes may be of interest to him (unless notified otherwise by e-mail by the Customer that he does not wish to receive the same); and

    2.9 for the purposes of complying with any provision of any law, bye-law, rule or regulation or otherwise pursuant to any order, judgment or direction of any court or governmental or quasi-governmental authority.

  3. Provision of Information to Third Parties

    Dekal is committed to providing its Customers with a high level of privacy in relation to the personal information that is collected by Dekal online. Personal information supplied by Customers and prospective customers will not be released to third parties, except under the following conditions:

    (a) information may be shared with participating partners but this information is limited to what is required to implement services to be provided by other complementary service and technology partners and will only occur with your consent to participate in such services;(b) to assist Dekal's professional advisors regarding matters referred to them concerning the operation of the Website;(c) as required by a court order or any other legal or regulatory requirement; and (d) as specified in Section 2 above.

  4. Undertaking of Dekal

    Dekal further represents and undertakes that apart from the use of the Customer Information as described above, it shall not trade in, deal with or exchange any of the Customer Information for money or money's worth or otherwise.

  5. Non-Applicability of Policy

    To the extent that the Customer makes available the Customer Information to other parties, whether on Dekal's Website or other websites, the practices of such other parties or sites will apply. The policies of these third parties may differ from Dekal's practices as stated in this Policy. The Customer agrees that it shall not hold Dekal responsible or liable in any way for the collection or use of the Customer Information by such third parties.

  6. Third party websites

    Dekal is not responsible for the privacy policies of third party websites to which links are provided. The privacy policies on these websites should be reviewed before providing any personal information to these websites.

  7. Payment Using Credit Card Information & Security

    Dekal uses the highest standards of payment transaction methods available on the internet.

    If You are paying for Your purchase by credit card You will be receiving the highest level of security for Your card available on the internet as well as ease of use and convenience. The reason You will be receiving this high level of service is because Dekal processes all credit card transactions ("Payment Processing") using the services of National Commercial Bank Jamaica Limited ("NCB"). Dekal accepts VISA, MASTERCARD and NCB's KEYCARD. NCB is a licensed bank regulated under the laws of Jamaica.

    All payment transaction information passed between Dekal's Website is encrypted using 128-bit SSL certificates. No cardholder information is ever passed unencrypted. Dekal and NCB uses 128-bit secure server (SSL) to ensure all Your information are encrypted before they are sent to Dekal. That means no one else can read Your personal information, credit card details, etc. other than Dekal and NCB's secure server.

    Dekal also follows strict security procedures and protocols in the storage and disclosure of information which You have given to Dekal, including those procedures and protocols to prevent unauthorised access or improper use of Customer Information.

    No individuals within Dekal are able to decrypt transaction information or cardholder data. Dekal's systems only allow access to Dekal's most senior staff and only in extenuating circumstances (such as investigations of Card Fraud by the Police). Your transaction information and customer card information is secure even from Dekal's own employees because Dekal's systems never display the full card numbers, even on administration screens.
